Homolka's lawyers to fight restrictions
CTV.ca News Staff Karla Homolka's lawyers will be in a Quebec courtroom again today, this time to fight a court order restricting her movements. Homolka, 35, woke up a free woman this morning, after leaving prison Monday. She had served a 12-year sentence for manslaughter in the deaths of Ontario schoolgirls Kristen French and Leslie Mahaffy, as well as her 15-year-old sister, Tammy. Now that she is free, her movements have been restricted by a special court order under section 810 of the Criminal Code. Her legal-aid lawyers are expected to file documents in court in Joliette, Que., today in an effort to contest those restrictions on her movements. Under the court order, she is required to report to a police station once a month, let police know if she plans to leave her residence for more than 48 hours, not contact her victims' families, and provide a DNA sample. She must also advise police of any changes to her name, appearance, residence, as well as let them know where she will be living and working. If she violates the conditions, Homolka could be sent back to jail for 24 months. On Monday, her lawyers were in court trying to get an injunction banning the media from reporting on her life post-prison. An earlier attempt had failed. Homolka has been ordered to return to the courtroom on the week of July 25 to defend her point of view that her life is in danger from vigilantes who will be able to find her because of media coverage. It's not clear if she will testify. Ironically, while her lawyers were fighting to keep her from the spotlight, her first stop after leaving prison was to RDI, Radio-Canada's all-news French station. In her interview, which was televised, Homolka spoke exclusively in French. She told the audience that while she was free from prison, she lived in an "interior prison." "I don't want to be hunted down,'' she told RDI. "I don't want people to think I'm someone dangerous who will do something to their children." When asked what was the first thing she wanted to do now that she was out of jail, Homolka said she wanted to get an iced cappuccino from Tim Hortons. |
